These Terms of Service govern the use of WerkGenie.io and all related services, technologies and functionalities provided by WerkGenie. By creating an account or using any part of the Service, the User accepts these Terms in full. If the User does not agree, they must discontinue use immediately.
WerkGenie refers to the entity providing the platform and related features, including AI-based tools, dashboards, communication systems and subscription services. User refers to any individual or entity accessing or using the Service, including Employers, Job Seekers and Recruiters. Employer refers to any User posting vacancies or reviewing candidates. Job Seeker refers to any User creating a profile for matching to vacancies. Recruiter refers to Users managing accounts for multiple employers if this role is enabled. Service refers to all features provided by WerkGenie, including AI matching, screening, chat, dashboards, vacancy creation and notifications. Content refers to all data submitted, generated or displayed on the platform.
These Terms apply to all access to and use of the Service. Users must be at least 16 years old. By registering, the User confirms that they are legally permitted to use the Service according to the laws of their own jurisdiction.
WerkGenie provides an AI-assisted platform for job matching and communication. All vacancy descriptions, job seeker summaries and match assessments are created or enhanced by automated systems. WerkGenie does not guarantee the completeness, accuracy or legal compliance of any AI-generated output. Matching occurs solely within the platform. Users may not upload vacancies created outside WerkGenie. Anonymous AI-mediated communication is used until both parties accept a match. Only after mutual acceptance does direct chat become available. Contact information may only be exchanged through the designated on-platform sharing tools. WerkGenie may send notifications, including email alerts, system updates and messages related to account activity.
Employers may access free or paid subscription tiers. Payments are processed through third-party providers and are billed in advance. Subscriptions renew automatically unless cancelled before the next billing cycle. Fees are non-refundable unless required by applicable law.
WerkGenie uses AI for profile creation, vacancy drafting, match interpretation, screening, conversation mediation and suggestions. AI output may contain inaccuracies or omissions and should not be relied upon as fact, advice or legal guidance. Employers remain solely responsible for evaluating candidates, verifying information and ensuring compliance with employment laws. WerkGenie provides no guarantees regarding hiring outcomes or match suitability.
WerkGenie stores and processes data in the European Union and uses EU-based providers for AI processing and notifications. Users agree to the processing of their data according to WerkGenie's Privacy Policy. Conversations—including anonymous AI-mediated messages and direct chats after mutual acceptance—may be stored for safety, dispute resolution, abuse prevention and product improvement. Sensitive or prohibited content may be filtered and restricted. Users may request deletion of their conversations; deleted messages will not be used for product enhancement. WerkGenie may use aggregated, fully anonymized data for analytics, performance measurement and feature development. Employers may export data only when candidates have explicitly consented and solely for legitimate hiring purposes. Exported data may not be used for commercial databases, resale, advertising or external recruitment systems.
Users must comply with strict content and behavior rules. The following is prohibited: discriminatory content based on age, gender, race, ethnicity, nationality, religion, disability or other protected characteristics; misleading, false or illegal job postings; spam, scams or pyramid schemes; hate speech, threats, harassment or abusive behavior; sexual, violent or extremist content; posting or requesting sensitive personal data; sharing contact information in profiles or vacancy descriptions; scraping, harvesting or collecting data from WerkGenie; automating access without permission; mass messaging outside approved tools; reverse engineering of the Service; uploading content created outside WerkGenie; or any activity violating the integrity, security or lawful operation of the platform. WerkGenie may remove or modify content, limit account access, suspend Users or block accounts entirely in cases of misuse or violation of the Terms.
WerkGenie's total liability for any claim related to the Service is strictly limited to the lesser of the total amount paid by the Employer during the preceding three months or one month of subscription fees. WerkGenie is not liable for indirect, incidental, special, punitive or consequential damages, lost profits, lost opportunities, hiring decisions, employment relationships, candidate behavior or any reliance on AI-generated content. WerkGenie is not responsible for disputes between Employers and Job Seekers or any off-platform interactions.
Users agree to indemnify, defend and hold harmless WerkGenie, its affiliates, employees and agents from any claims, liabilities, losses, damages or expenses arising from User-generated content, illegal or misleading job postings, misuse of the Service, violations of these Terms, or disputes between Users, including Employer–Job Seeker disputes.
WerkGenie retains ownership of all platform components, AI systems, algorithms, branding, interfaces and design elements. Users receive a limited, non-exclusive license to access and use the Service. Users may not copy, distribute, resell, sublicense, modify or reverse engineer any part of the Service. AI-generated content may be used within the platform but does not grant any intellectual property rights beyond normal platform usage.
If recruiter functionality is enabled, Recruiters may only act on behalf of authorized Employers. Recruiters must maintain confidentiality across companies and may not transfer information between them. WerkGenie may revoke recruiter access at any time.
Beta features are experimental and provided as-is, without warranties or performance guarantees. These features may be modified, suspended or removed at any time. WerkGenie is not liable for any issues arising from the use of beta functionalities.
WerkGenie may suspend or terminate accounts at its discretion for violations, misuse, fraud, legal non-compliance or actions harmful to the Service. Users may stop using the platform at any time. Upon termination, the User's access to the Service ends immediately.
These Terms are governed by general international contractual principles. WerkGenie may choose the jurisdiction for dispute resolution, typically the jurisdiction where WerkGenie is legally established. Users agree that any claim must be brought exclusively before the competent court selected by WerkGenie.
WerkGenie may update these Terms at any time. Material changes will be communicated in advance to Users, who must accept the updated Terms to continue using the Service.
